1. Who we are and what these terms cover
My HW is provided by Forty Two Labs Ltd, a company registered in England and Wales (company number 16993007), with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ ("we", "us", "our").
These terms and conditions ("Terms") govern your use of the My HW app on iOS, the My HW web app at web.myhw.app, and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Our Privacy Policy explains how we handle your personal data and forms part of these Terms. You can contact us at hello@myhw.app.
2. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your country) to create an account. Children take part in My HW only through accounts, profiles, and groups created and managed by a parent, guardian, teacher, or tutor — children cannot register for the Service themselves.
If you create an account, profile, or group on behalf of a child, you confirm that you are that child's parent or guardian, or that you have the appropriate authority (for example, as a teacher or tutor acting with the school's or parents' authorisation) to do so, and you accept these Terms on the child's behalf.
You are responsible for keeping your login details secure and for all activity under your account. If you believe your account has been compromised, contact us promptly at hello@myhw.app.
3. Roles and groups
My HW allows parents, students, teachers, and tutors to share homework, assignments, and progress within groups. If you create or administer a group, you are responsible for who you invite into it and for the content shared within it. When adding a child to a group, you confirm you have the authority described in section 2.
If you leave a group or delete your account, your participation in groups created by others is anonymised rather than deleted, so that other members' shared records are not disrupted (see our Privacy Policy for details).
4. Subscriptions and payment
Parts of the Service are free to use with limited features. Additional features are available through paid subscription tiers (currently Starter, Plus, Pro, and Ultimate), each offered on a monthly or yearly basis.
- Billing via Apple. Subscriptions purchased in the iOS app are billed by Apple through your App Store account. Payment is charged on confirmation of purchase, and subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Managing and cancelling. You can manage or cancel your subscription at any time in your App Store account settings. Cancellation takes effect at the end of the current billing period. Refunds for App Store purchases are handled by Apple in accordance with its policies.
- Family Sharing. Availability of Apple Family Sharing varies by tier, as described in the app.
- Direct and institutional plans. Some plans may be purchased directly from us, in which case separate invoicing and payment terms will apply as agreed with you.
- Price changes. We may change subscription prices from time to time. Any change will be notified in advance and will apply from your next billing period.
Nothing in this section affects your statutory rights as a consumer.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or in a way that infringes anyone else's rights
- Upload or share content that is abusive, harassing, defamatory, obscene, or otherwise inappropriate, particularly given that children use the Service
- Misrepresent your identity, your role, or your authority over a child
- Attempt to gain unauthorised access to the Service, other users' accounts, or our systems
- Interfere with or disrupt the Service, or introduce viruses or other harmful code
- Copy, modify, reverse engineer, or create derivative works of the Service, except as permitted by law
- Use the Service to send spam or unsolicited communications
We may remove content or suspend accounts that we reasonably believe breach these Terms.
6. Your content
You retain ownership of the content you enter into the Service, such as homework, assignments, notes, and attachments ("User Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, and display User Content solely as needed to operate and provide the Service. This licence ends when the relevant content is deleted, subject to the retention practices described in our Privacy Policy.
You are responsible for the User Content you submit and confirm that you have the rights necessary to share it.
7. Our intellectual property
The Service, including its software, design, branding, and all content we provide (excluding User Content), is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal or educational use in accordance with these Terms. You may not use our branding without our prior written consent.
8. Third-party services
The Service relies on third-party services, such as Apple (App Store, Sign in with Apple, push notifications), Google (sign-in), and the service providers described in our Privacy Policy. Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.
9. Availability and changes to the Service
We may need to suspend the Service for maintenance, updates, or security reasons. We may add, change, or remove features from time to time; if we make a change that materially reduces the Service you have paid for, we will notify you and you may cancel your subscription.
10. Termination and account deletion
You can stop using the Service and delete your account at any time via Settings → Danger Zone. Account deletion is immediate and permanent, and includes the deletion of any groups you created or administered, together with all homework and progress data within them, as described in our Privacy Policy.
Deleting your account does not automatically cancel an active App Store subscription — you must cancel it separately in your App Store settings.
11. Disclaimers
My HW is an organisational tool for planning and tracking homework. We do not provide educational or tutoring services ourselves, and we are not responsible for the accuracy or quality of content entered by users, or for academic outcomes. To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind beyond those required by law.
12. Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, nothing in these Terms affects your statutory rights.
Subject to the above, our total liability to you in connection with the Service is limited to the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) £50.
13. Additional terms for the App Store (Apple)
These Terms are between you and us, not Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Changes to these Terms
We may update these Terms from time to time. If we make significant changes, we will notify you via the app or by email before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. If you are a consumer, you will also benefit from any mandatory protections of the law of the country where you live. Disputes may be brought in the courts of England and Wales, or in the courts of the country where you live if you are a consumer resident in the UK or EEA.
